Custom Fairytales is operated by 10335401 Canada Inc., Toronto, Ontario, Canada («we», «the service»). By creating an account, uploading material or paying for a product, you agree to these terms.
1. Who may use the service
The customer must be an adult with legal capacity to enter into a contract. The service is built for parents, guardians and other adults who have permission to create a book about a child. It is not intended for unsupervised use by children.
2. Your material and your consent
You keep all rights to the text and photographs you upload. You confirm that you are allowed to share them with us and to authorise the processing needed to create the book. You grant us a limited licence, solely to store, transform and transmit that material to our generation and printing providers in order to fulfil your order.
You must not upload material you do not have consent for, sexualized or degrading images of children, unlawful content, other people’s identity documents, payment details, or images that infringe someone else’s copyright. We may stop such an order and delete the material.
3. AI generation
Stories and illustrations are produced with generative AI. Results may include artistic deviations, inaccuracies or unexpected details. The sample exists so you can check the idea and the style before the whole book; it is priced in credits, and the welcome gift covers it. Before buying a print, the customer is responsible for reviewing the final book, including names, text and images.
4. Credits
Every account receives a one-time gift of credits when it is created, and that gift is what pays for the digital side of the service: the sample, the complete book and every HD PDF, including repeat renders. Drawing work is always accounted for in credits — there is no unmetered free tier. Credits can also be topped up for money. Credits are not money, cannot be transferred between accounts and have no cash value outside the service.
5. Digital and printed book
Completing a book means drawing the stated number of pages; the HD PDF is free. Generation times are estimates and depend on the queue and on third-party AI services. A printed hardcover and a cartoon made from a finished book are paid separately, in money. Printed books are personalized and made on demand. Price and shipping are shown before payment; manufacturing delays are possible.
6. Intellectual property
To the extent permitted by applicable law and by our AI providers’ terms, we grant the customer a perpetual right to use the finished book for personal and family purposes, to share it privately and to print copies. The Custom Fairytales code, brand, templates, interface and underlying technology remain our property.
7. Limitation of liability
We will provide the product you paid for with reasonable care, but we cannot guarantee uninterrupted operation of third-party AI, email, Stripe or Lulu services. Nothing in these terms removes mandatory consumer rights. Otherwise, our total liability is limited to the amount paid for the order in question.
8. Governing law
These terms are governed by the laws of Ontario and the applicable federal laws of Canada. This is an internet agreement, and your copy of the agreement and payment confirmation are delivered electronically. If mandatory law in your province or country gives you additional protection, that protection continues to apply.
